Personal Property vs. Real Property - Understanding the difference, avoid the causes
Let's take a look at the personal property as a confrontation with real estate. This is a topic that is a lot when a real estate transaction becomes difficult and the two parties (buyer and seller) begin to discuss what remains in the home and what is not under the contract and law.
Personal property is defined as all goods that can be owned and does not fit the definition of real estate. In other words, if it is not real property, then it is personal property. An important distinction between the two is that the personal property is movable. Personal property is also referred to as chattels. For those of you who like to work on expanding your vocabulary.
Next we see some examples of personal property including housing, building, plants, crops and equipment classifications.
Manufactured housing is defined as dwellings that are built to the main site. These are normally transported and placed on the property. For those of you breaking down the word product, and wonders why all manufactured homes are not considered, since they are after all "manufactured" to think of mobile homes as manufactured. Here's the tricky part, if the house building was attached to the property, then it is real property, if you just sit there and connected to utilities, then it is personal property. Why is it important? well, if it comes to property, then property taxes are higher because the government sees the houses primarily as an added value for the land that sits on.
Plants and crops: There are two categories here, and both have their differences. Trees, perennials, shrubs and grasses that do not require annual cultivation are considered real property or real property. And these transfers with the sale of the property. Crops on the other hand that is collected on an annual basis, are considered emblements. Or the ownership and sale of property, crops that are produced by living with the seller that the current harvest.
Here are some additional details ... if an element on earth, say a tree (which is property) is cut and separated from the earth (called separation), then it becomes personal property. E 'can also do the same thing, but in the opposite direction. If the tree that was cut is used to build a home property through annexation, become immobile.
Calendar - these are often the hot topic in the sale of a house because sellers often take the games with them when they move, and this is against the agreement required by the contract. Knowing what is a fixture, will help you understand what to expect to stay with the house and what not. Equipment is personal property that has been affixed (attached) to the land or building, and become immobile. Remember property stays with the house when you sell it.
How do I check if an element is a device or personal property? Here are the three basic tests to use the courts to decide.
1. Method of Annexation - how permanent is the method of attack? Can the item be removed without damaging the surrounding property?
2. Adaptation to Real Estate - The element used as real estate or personal property? For example, a refrigerator is usually considered private property because it can be removed easily. However, if the refrigerator has been adjusted to match the kitchen cabinets, has become a fixture.
3. Agreement - Have the parties agreed that the item is real or personal property in a purchase offer.
The general rule is to determine which is the purpose of the fixture? It is his function as the personal property or real estate.
Fixtures commercial are the exception to the rule. A commercial unit is the property used by businesses. Often it will be attached to the property and look like real estate. However, if it is something we use as part of the trade as a seller is considered personal property and not stay with the house.
Often, home buyers will seek to homes and what draws them to the house will be certain aspects of the house. Calendar as entertainment centers, backyard gazebo and surround sound systems and are often considered the property which will remain with the house. However, a landlord may consider the elements of great value and can be scheduled to make their new home. It 's very important to identify which devices you want and expect to stay at home and put the items in the purchase agreement so that everyone will be on the same page and agree from the start .......
